Guidance For Those Submitting Pre-Applications by December 31, 2006 For Loan
Guarantees for Innovative Technologies Under Title XVII of the Energy Policy Act
of 2005 Under Solicitation Number DE-PS01-06LG00001
WASHINGTON, DC – As noted in its Guidelines for the operation of its Loan Guarantee Program,
and in its August 8, 2006 Solicitation, DOE was awaiting Congressional action that
would provide funding for the operation of its Loan Guarantee Program Office,
legal authority to make use of the Title XVII "self-pay" provisions within limits
to be set by the Congress, and authority to use administrative fees paid by Applicants
to fund the continued operation of the loan guarantee program.
In anticipation of enactment of these authorities by the 109th Congress, DOE stated
in Section E of its Solicitation that "Upon a favorable review of a Pre-Application
by the Credit Review Board, DOE will endeavor to issue written Invitations To Submit
An Application For a Loan Guarantee within 90 days from the closing of the date for
submitting Pre-Applications." Since Congress was unable to complete action on the
funding and authorities DOE had sought, DOE finds it necessary to advise those who
file timely Pre-Applications for Loan Guarantees that it no longer anticipates being
able to respond to Pre-Applications within the time frame contemplated in the Solicitation.
While awaiting favorable Congressional action in the next Congress, DOE will use the
resources available to it to commence reviews of the timely submitted Pre-Applications
in an effort to make as much progress as possible in the interim. At the same time,
DOE also plans to complete its efforts to issue a Notice of Proposed Rulemaking which
will lead to the adoption of final regulations to govern the Loan Guarantee Program
and subsequent solicitations that will encompass all of the technologies envisioned
in Title XVII.
